Firstly, I am not making this up or at least intentionally.

I attended the POL function on Saturday and I was pretty wrecked by the time I arrived at my street party, where I drunk quite a bit more. I seem to recall a conversation about the Golf Course and the fact that it was gifted to the Council some years ago by Earl someone or other.
Apparently there was a condition in the gift that prevented the playing of sports on a Sunday. If true, then the condition has obvioulsy been relaxed. Perhaps not enough to block a move by the Pitz?

How can we find this type of thing out? Has anyone else heard anything similar?

First place I'd recommend digging is the Canmore and PASTMAP searches on http://www.rcahms.gov.uk/ - I'd have a look now, but got to get back the cooking!

And it's be the Earl of Abercorn I guess?

EDIT: Of course this isn't going to tell you if the claim is true, but it'll probably give a bit of historical perspective. Our friends at the Registers of Scotland would be the next port of call I guess - to see the deeds.

Interesting to know whether that kind of burden would be enforceable nowadays. Not looked at a conveyancing textbook in about two years, but may take a peek tomorrow...

I've had a look and doesn't seem like there is any substance to it. What I did find out is the council let the Pitz site for a staggering Ã‚Â£7500 per annum (1998 reviewed in 2003). To put that in perspective, Kirkwood Fashions was on the market earlier this year for Ã‚Â£30,000+pa.

Whomever was responsible for that piece of business deserves shooting,but they are probably Head of Department now?

Getting off topic slightly (but not as much as you two!), I'm sure there's something similar with the Christiemillar Estate in that strictly speaking if someone wants permission to change something to do with land useage they should really seek permission from the Christiemillar Estate on which the houses were built. My friend had a problem with a neighbour building a garage too close to her house a few years back and this was one of the loopholes her lawyer was looking into to prevent the garage being built. Don't think it worked though but interesting nevertheless
